Privacy Statement FG Lawyers

FG Lawyers B.V. (hereinafter “FG Lawyers”, “we” or “us”) is a private limited company and its purpose is to practice law. In this context, FG Lawyers receives and processes personal data as referred to in the General Data Protection Regulation (GDPR). In this document, FG Lawyers informs you, in accordance with the GDPR, among other things, for which purpose these data will be processed, the legal grounds for data processing and how you can make use of your rights under the GDPR.

We may unilaterally amend this privacy statement, which is dated September 12, 2022.

1. Personal Data
We obtain personal data either because you provide it to us, because it can be accessed from a public source or because we receive it from a third party. Information that we receive from a source other than you (public source or third party) may include, for example, the following categories of personal information:

  • basic information as recorded in the Trade Register or Land Registry;
  • data relating to your identity (for example, another law firm);
  • other public data that may be useful for the purposes as set out in this privacy statement, such as case law, (online) articles and social media profiles or data provided with your knowledge by a third party such as a lawyer counterparty.

Which personal data is requested and what we receive differs per case. At all times, we will only request data that can be useful in carrying out one or more of the purposes listed below, such as handling your case. If you refuse to provide the data requested by us, for example data required pursuant to the Wwft, we will not enter into a business relationship with you.

2. Purposes and retention period
We process the personal data that we receive exclusively in order to:

  • provide legal services including legal advice and litigation;
  • comply with the legal and/or judicial obligations applicable to us, including the obligations under the Money Laundering and Terrorist Financing (Prevention) Act (Wwft) and the Legal Profession Bye-law (Verordening op de advocatuur);
  • to alert you or your organization to news, developments and events that may be of interest to you as a client of our firm;
  • collect information about the use of our website;
  • to carry out a job application procedure (recruitment and selection purposes).

We will keep the personal data we receive, subject to statutory retention obligations, for no longer than is necessary to carry out the above purposes.

3. Legal grounds for processing and legitimate interest
All processing that takes place in the context of the purposes set out in this Privacy Statement are based on one or more of the following legal grounds:

  • Execution of an agreement to which you are a party;
  • Compliance with a legal obligation;
  • Legitimate interest of FG Lawyers or a third party, such as carrying out direct marketing activities for FG Lawyers or combatting criminal offences;
  • Your consent.

4. Recipients of personal data
We will only share personal data with third parties to the extent necessary for the purposes set out above. Parties with whom we may share personal data are:

  • persons involved in the legal services;
  • lawyer counterparty, judicial authorities and/or regulators;
  • parties engaged by FG Lawyers to provide support services, such as ICT suppliers and the accountant.

5. Your rights
Under the GDPR, you have a number of rights in relation to your personal data, namely:

  • right of inspection;
  • right to rectification;
  • right to erasure of data;
  • right to restriction of processing;
  • right to data portability;
  • right to object;
  • right to lodge a complaint with the supervisory authority; and
  • right to withdraw the consent you have provided.

You may exercise your rights by notifying us via the contact details set out in section 6 ‘Controller’. If you exercise the right to rectification, erasure and/or restriction of processing, FG Lawyers will reasonably inform the other recipients of this data.

7. Personal data security
FG Lawyers has taken appropriate technical and organizational measures to protect personal data against loss or against any form of unlawful processing.

8. Cookies
The website of FG Lawyers does not place cookies for which prior consent is required. The settings of the services from Google Analytics and Hotjar are set to use only functional and analytical cookies. The cookies collect data in pseudonymized or anonymized form. The data collected in this way include your IP address, the type of device used and geographical location (country only). We use this data to analyze the effectiveness and usability of the website.
